Guests acknowledge and agree that present Terms of Use and specific rules are binding provisions. Guests are the renter and his co-renters, co-travelers/co-roommaters.
ACCOMMODATION : 1. rent is not transferable to third parties, 2. management reserves the right to change the lay-out of the accommodation at any time.
CANCELLATION BY GUESTS DURING A NON PANDEMIC PERIOD: guests are at any time allowed to cancel the reservation. In case of cancellation until four weeks before the start of the reservation 30% of the total reservation amount is due. In case of cancellation within four weeks before the starting date of the reservation, 100% of the reservation amount is due. It is strongly recommended to purchase a travel insurance. Check the provisions of your credit card, a travel cancellation insurance is often provided.
CANCELLATION BY GUESTS DURING A PANDEMIC: for all reservations rescheduling of your reservation is possible (at no expense) when your reservation is affected by the covid travel restrictions. Rescheduling is possible when 1. your authorities have issued 'new' travel restrictions from and to Bonaire 2. Bonaire has issued 'new' travel restrictions from or to Bonaire. In case of rescheduling the already paid amount will be applied to the new travel dates. Seasonal surcharges may apply. When travel restrictions apply at the time of reservation, these are not a valid reason to reschedule your reservation if they still apply at the time of your travel. A travel restriction is a flight ban, a negative travel advisory or complete closure of airspace.
CANCELLATION OR ALTERATION BY CHAKAMAKA is possible at any time 1. in the event of force majeur (i;e war, strike, natural disaster, fire, death of owner/lessor,...) 2. and - after being warned - continuing nuisance for the environment/neighbors and other third parties 3. not acting as a good house father.
CHECK-IN & CHECK-OUT: check in from 4 pm on arrival date and check out until 11 am on departure date. Late check-out is possible against payment if the accommodation has no arrival on the day of departure. Chakamaka will do its utmost to have the accommodation ready at 4pm.
DAMMAGE : guests act like a good family man/woman and guests use devices/materials for what they are designed for and not for other goals. Direct and cross collateral damage caused by guests will be recovered from the guests. Guests keep the accommodation in a normal state of maintenance. If this is not the case and extra maintenance is required, a minimum of $100 will be charged.
GUEST AGE: minimal 18 years.
HOURS OF SILENCE: people and devices go into silence modus between 10 pm and 7 am.
HOUSE RULES : The house rules are contained in these general conditions and in your guest guide. The house rules differ according to the accommodation. In case you don’t receive the guest guide at the moment of your reservation and at the latest 8 days prior to your arrival, please let us know. If you do not notify us, we assume that you have received the guest guide. By making a reservation, you are committed to adhere to the house rules. We can not pro-actively foresee and describe every possible situation in these general conditions & house rules. Therefore, we reserve the right, if a situation occurs which is not described in these general conditions/house rules, to determine what may or must (not) occur.
KEYS OR REMOTES : lost of damages keys or remotes will be charged.
LAW AND JURISDICTION: only law of Bonaire is applicable and only the court of Bonaire is competent.
LIABILITY: guests exempts management from any liability due to accidents and/or events that happen to the guest(s) on the premises of the rented accommodation. Expenses incurred by this accident or event will be borne by the guest. Guests relieve, fully indemnify and hold harmless the (beneficial) owner(s) of the accommodation for and from any loss, cost, claim, damage. Management is not liable for theft or loss of belonging of the guest(s). Guests therefore contracts an own insurance for accidents, damage, loss and cancellation Management is not liable for contracted external services or information provided by third parties.
MAINTENANCE: accommodations need maintenance and maintenance personnel are present at certain timings.
PARTIES and loud music are not allowed.
PAYMENTS (for reservations via a third party like Airbnb ) : we send you an email with a payment link. This email is sent from Your.Bonaire.Stay@host.smoobu.com. The payment is processed via the payment systems of Paypal or Stripe (depending on your place of residence). If payment is not made within the specified period, we will regard this as a cancellation.
PETS : not allowed
RESERVATIONS are secured after having paid the required amount within the communicated timeframe.
REGISTRATION: all guests must complete the online check-in.
RIGHT OF ADMISSION: The stay of additional guests varies per accommodation, and the rules regarding this are determined in the guest guide of the respective accommodation.
SATISFACTION : If something is not entirely satisfactory, let us know within 24 hours otherwise we can not take your complaint into account.
SMOKING is only allowed outside the accommodation but never near or under with palm leafs covered premises/palapas;
